Welcome to Mr. Cesspool. These Terms and Conditions (“Terms”) govern all services, equipment rentals, maintenance agreements, and website use provided by Mr. Cesspool (“Company,” “we,” “us,” or “our”) to customers, contractors, event hosts, and site managers (“Client,” “you,” or “your”) across Eastern Massachusetts and Rhode Island.

By requesting a quote, booking equipment, scheduling service, or using our website, you agree to comply with and be bound by these Terms.

1. Services & Rental Scope

• Septic Services: Includes septic tank locating, residential/commercial pumping, routine maintenance, and natural digestant applications.

• Portable Sanitation Rentals: Includes standard and deluxe port-a-jons, green-certified units, ADA-compliant restrooms, luxury restroom trailers, freestanding hand-wash sinks, hand sanitizing trees, and job trailer fresh water recovery systems.

• Service Schedules: Service intervals (weekly, bi-weekly, or on-call) are established upon booking. Any additional emergency or unscheduled pump-outs will incur standard dispatch fees.

2. Site Placement, Access & Conditions

• Access Requirements: The Client must provide clear, unobstructed access for our service vehicles (up to 5,000-gallon vacuum trucks and delivery trailers). Driveways, access roads, gates, and delivery routes must accommodate heavy commercial equipment.

• Safe & Level Placement: Portable restrooms and trailers must be situated on dry, stable, and level ground. Equipment will not be placed on steep grades, swampy terrain, or areas where service trucks risk becoming stuck or damaging property.

• Relocation: Restrooms, sinks, and trailers must not be moved by the Client or third parties once positioned by Mr. Cesspool personnel without prior authorization. Unauthorized relocation voids damage protections and may incur service fees if units cannot be serviced.

• Septic Tank Access: For septic pumping, the Client is responsible for marking or clearing access to tank covers/lids unless locating and uncovering services are explicitly contracted.

3. Equipment Care, Prohibited Uses & Damages

• Acceptable Use: Portable toilets, luxury trailers, and waste holding tanks are engineered strictly for human bodily waste and standard toilet paper.

• Prohibited Items: Under no circumstances may trash, construction debris, diapers, feminine hygiene products, wipes (including flushable wipes), chemicals, fuels, paint, needles, or hazardous materials be placed into rental units or septic systems.

• Client Liability: The Client is fully responsible for loss, theft, vandalism, graffiti, fire, tip-overs, or mechanical damage to rental equipment while on the Client’s property or jobsite. In the event of damage or total loss, repair or replacement charges will be billed directly to the Client.

• Tipping & Spills: If a unit is tipped over or damaged due to site conditions, high winds, or vandalism, the Client must notify Mr. Cesspool immediately for emergency cleanup, which may be subject to additional service fees.

4. Utility Requirements for Specialized Units

• Luxury Restroom Trailers: While units are self-contained for water, the Client must supply two dedicated 110V / 20A electrical receptacles within 50 to 100 feet of the trailer (or an approved commercial generator). Mr. Cesspool is not liable for service interruptions caused by customer-supplied power failures.

• Fresh Water Recovery Systems (Job Trailers): The Client must ensure power is provided to operate onboard delivery pumps and that freeze-protection measures are maintained during freezing weather.

5. Pricing, Billing & Cancellations

• Invoicing & Payments: Standard event rentals require payment or security deposits prior to delivery. Commercial and construction accounts are billed per agreed rental cycles (weekly/monthly). Payment terms are Net 30 unless otherwise stated.

• Overages & Extra Servicing: Jobsites exceeding agreed crew capacities or ANSI standards that require unscheduled pump-outs will be billed at applicable overtime or per-service rates.

• Event Cancellations: Cancellations for event restrooms or luxury restroom trailers must be made at least 14 days prior to delivery to qualify for deposit refunds (minus administrative fees). Weather-related cancellations made after dispatch or setup are non-refundable.

6. Environmental Regulations & Compliance

• All waste is transported, handled, and discharged in strict accordance with the Massachusetts Department of Environmental Protection (MassDEP), the Rhode Island Department of Environmental Management (RIDEM), and local municipal board of health regulations.

• Mr. Cesspool reserves the right to refuse service or remove units immediately if hazardous materials, chemical contamination, or illegal dumping is discovered on site.

7. Limitation of Liability & Property Disclaimers

• Driveways & Lawns: Mr. Cesspool utilizes lawn-friendly practices and driveway-safe hoses. However, the Company is not liable for cracking, rutting, depression, or damage to driveways, pavers, curbs, lawns, or underground utilities caused by the weight of heavy vacuum trucks or delivery vehicles where the Client instructed placement.

• Pre-Existing Septic Deficiencies: Mr. Cesspool is not liable for structural failures, collapsed baffles, root intrusions, pipe settling, or leach field backups inherent to aging or compromised septic systems discovered during standard pumping.

• Force Majeure: We are not liable for delivery delays or missed servicing caused by severe weather (hurricanes, blizzards, flooding), road closures, civil emergencies, or conditions beyond our reasonable control.
